Treek’s Licensing Library terms & conditions
PLEASE READ THESE TERMS PRIOR USING OF TREEK’S LICENSING LIBRARY. WHEN YOU USE TREEK’S LICENSING LIBRARY, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
Definition of terms
“Documentation“: any explanatory written or on-line material including, but not limited to, user guides, reference manuals and HTML files.
“Licensee“: shall refer to the individual licensee, whether as an individual programmer, company, or other organization.
“Software“: All material in this distribution including, but not limited to, one or more of the following: source code, object code, byte code, dynamic-link libraries, shared libraries, static libraries, executables, scripts, sample programs, utility programs, and Documentation.
“Licensed Software“: the Software for which Licensee has paid the applicable license fee and received an authorized developer license code.
“End-User Software Product“: an application developed by Licensee intended for execution on a computer, that makes use of the Licensed Software in its implementation.
The Licensed Software contains certain runtime libraries and files intended for duplication and distribution by Licensee within End User Software Products to the user(s) of the End User Software Product(s) (the Redistributable Components). The Redistributable Components are those files specifically designated as being distributable as part of the Licensed Software.
General statements
The Software is owned by Jan Drozd software (“JDSW”) and is protected by EU copyright laws and other laws and by international treaties. It is intended for use by a software programmer who has experience using development tools and class libraries.
License grants
It is possible to redistribute TreeksLicensingLibrary.dll or TreeksLicensingLibrary2.dll within End User Software Products if you have paid for a license.
Evaluation:
You may freely use this software for evaluation purposes only. You may not redistribute Software within End User Software Products until you pay license fee.
Single developer license:
This license allows to single developer use and distribute Treek’s Licensing Library in unlimited number of applications.
Small team license:
This license allows to team (small organization, up to 5 developers) to use and distribute Treek’s Licensing Library in unlimited number of applications.
Unlimited/enterprise license:
This license allows to unlimited number of employees of one company to use and distribute Treek’s Licensing Library in unlimited number of applications.
Activation server license:
Licensee agree to be bound by the TLL Activation server terms & conditions in addition to this agreement.
Restrictions
Licensee may not decompile, disassemble, or reverse engineer any object code form of any portion of the Software.
In case Licensee receives any source code as part of order, Licensee agrees to not disclose Treek’s Licensing Library sources to any 3rd party entity or public service either for free or for any kind of payment. Licensee must not use TLL Core source code to create product which would compete with Treek’s Licensing Library on the market.
Title
Licensee acknowledges and agrees that all right, title and interest in and to the Software, including all intellectual property rights therein, are the property of JDSW, subject only to the licenses granted to Licensee under this Agreement. This Agreement is not a sale and does not transfer to the Licensee any title or ownership in or to the Software or any patent, copyright, trade secret, trade name, trademark or other proprietary or intellectual property rights related thereto.
Non-transferability
Except for Licensees rights to distribute the Redistributable Components, Licensee may not rent, transfer, assign, sublicense or grant any rights in the Software, in full or in part, to any other person or entity without JDSW written consent, except that this agreement may be assigned to a successor of Licensee in the case that all or substantially all of the assets or equity of Licensee are acquired by the successor.
Limited warranties
JDSW warrants to licensee, that software will work under conditions described on software’s website. Licensee may return software license until 30 days from purchase if software fails to work. To return license, Licensee must contact JDSW (via contact form on website) and provide technical details of failure. JDSW has then 14 days to bring resolution, which may result in software update, providing a how-to or returning money to Licensee. Resolution type is on JDSW sole discretion.
Termination
JDSW reserves the right, at its sole discretion, to terminate this Agreement upon written notice if Licensee has breached the terms and conditions hereof. Licensee to be provided written notification of breach and reasonable time to cure breach. Licensee may terminate this Agreement at any time by ceasing to use the Licensed Software and by destroying all copies of the Licensed Software (including the original). “Restrictions” described in this license remains valid even after termination of license. Termination will not affect end user licenses of End User Software Product.
Client reference
Licensee grants JDSW the right to use Licensee’s company name and logo for marketing purposes, including, but not limited to, reference lists, client portfolios, and promotional materials.
Privacy policy
We may collect some information about end users through features of some versions of our Software. By using our products, Licensee acknowledges that he has read, understands and agrees with our privacy policy.
Miscellaneous
LICENSEE ACKNOWLEDGES THAT HE HAS READ THIS AGREEMENT, UNDERSTANDS IT AND AGREES TO BE BOUND BY ITS TERMS AND CONDITIONS. LICENSEE FURTHER AGREES THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN LICENSEE AND JDSW WHICH SUPERSEDES ANY PROPOSAL OR PRIOR OR CONTEMPORANEOUS AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT
THIS SOFTWARE IS PROVIDED BY THE COPYRIGHT HOLDERS AND CONTRIBUTORS “AS IS” AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL THE AUTHORS OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
